Data we process
We process only the data strictly necessary, in accordance with the data minimisation principle (Article 5.1.c of the GDPR). Through the contact and booking forms we may collect identification and contact data: first name, surname, telephone and email address. This data is not collected until the user expressly accepts this Privacy Policy.
Purpose of the processing
The data is processed for the following purposes: managing information requests and excursion bookings, providing the contracted service and maintaining communication with the user. No automated decisions are taken and no profiling is carried out with the data provided.
Legal basis
The legal basis for the processing is the user’s consent, given by ticking the box accepting this Privacy Policy, and the performance of the contractual relationship when a booking is formalised.
Retention period
The data will be kept for as long as the relationship with the user is maintained and, once it has ended, for the periods legally required by tax, accounting or other obligations. Once those periods have elapsed, the data will be deleted.
Recipients and data processors
Data is not transferred to third parties except where legally required. In order to provide the service, 107 MARSYP, S.L. relies on technology providers that act as data processors (website hosting and email delivery). The following third-party services are also used:
- Google LLC — Google Analytics statistics service (analytics cookies are only installed with the user’s prior consent) and review synchronisation through Google Places, which is carried out on the server.
- Cloudflare, Inc. — Turnstile anti-spam protection service on the forms, which processes the user’s IP address to verify that the request is not automated.
Some of these providers may be located outside the European Economic Area; in such cases, international transfers are covered by the safeguards provided for in the GDPR.
User rights
Users may exercise the following rights: access, rectification, erasure, objection, restriction of processing, data portability and the right not to be subject to automated individual decisions. To exercise them, they may send a request —together with a copy of an identification document— to info@oceancruiserbenalmadena.com. Users also have the right to lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) if they consider that the processing does not comply with the applicable regulations.
